Penalties for Driving Under the Influence of Drugs in Florida
While it is common knowledge that drinking and driving can get you in trouble
with the law, it seems like fewer people are actually aware that driving
under the influence of drugs is also illegal. Whether it is any type of
illegal street drug or prescription medication, when your normal faculties
have become impaired, you can be arrested under Florida Statutes §316.193
(2012) and may face serious consequences.
Depending on the circumstances of your arrest, penalties may include:
- Six months in jail
- Up to $1000 fine
- Up to 50 hours community service
- Driver's license suspension for 180 days to a year
Defense Strategies for DUI with Drugs
During a drugged driving arrest, you cannot be given a breathalyzer test
to determine impairment. While it may be possible that the arresting officer
may require you to take chemical tests of the blood or urine, there is
no certain way to determine the exact moment the drugs were taken and
if the amount of drugs in your system is enough to cause impairment.
In DUI with drugs, the arresting officer will have to rely on his own observations
of erratic behavior and other tell-tale signs such as red eyes or slurred
speech for primary evidence. To defend you, our Fort Myers DUI attorney
will have to challenge the evidence at hand. We will vigorously cross-examine
the officer in court and convince the judge that your arrest is baseless
considering that the primary evidence is founded on subjective opinions
and not actual objective evidence. In case you were asked to perform a
Field Sobriety Test (FST), we will work tirelessly to subpoena the footage
from the police car dashboard camera and point out the conditions that
you were put through while performing the test including inappropriate
footwear, harsh weather, or intimidation from the arresting officer.
